Premarital Agreements are recognized as binding in Illinois provided they are entered into as the free and voluntary act without duress or coercion, are in writing and there has been a full disclosure of assets, liabilities and income. If a PreMarital Agreement waives or restricts maintenance (formerly called alimony) this can't cause undue hardship in light of circumstances not reasonably foreseeable at time of execution. PreMarital Agreements deal with how spouses will deal with his or her separate property during the marriage, establishes the rights and responsibilities, including marital property division, maintenance and attorneys' fees, and rights upon the death of a spouse during the marriage.
