If a PreMarital Agreement waives or restricts maintenance (formerly called alimony) this can't cause undue hardship in light of circumstances not reasonably foreseeable at time of execution. PreMarital Agreements deal with how spouses will deal with his or her separate property during the marriage, establishes the rights and responsibilities, including marital property division, maintenance and attorneys' fees, and rights upon the death of a spouse during the marriage.
